Ascend Group Australia provides booking, coordination, and facilitation services for contractors. While we take reasonable care to ensure entertainer profiles, images, and descriptions are accurate and professionally presented, we do not guarantee that:

  • Promotional images or media are fully up to date at the time of booking

  • An entertainer’s appearance, styling, or presentation will be identical to promotional material

  • Any specific look, outfit, or aesthetic featured in promotional content will be replicated at the time of service

All images, videos, and promotional materials are provided for illustrative purposes only and are not a guarantee of exact appearance or performance outcome.

No Reliance on Promotional Material

The Client acknowledges that all promotional content (including photographs, videos, social media content, and website imagery) is intended as a general representation of style and entertainment type only. The Client agrees not to rely solely on promotional material when forming expectations of a booking. Final services are provided strictly in accordance with the confirmed booking details only.

Independent Contractor Disclaimer

All entertainers and service providers engaged through Ascend Group Australia are independent contractors and not employees, agents, or representatives of Ascend Group Australia. Accordingly, we are not responsible for:

  • The conduct, actions, or behaviour of entertainers

  • Any statements or representations made by entertainers outside confirmed booking terms

  • Personal decisions or conduct of entertainers before, during, or after an event

Limitation of Liability (Property, Injury & Loss)

To the maximum extent permitted by law, Ascend Group Australia accepts no responsibility for:

  • Any damage to property

  • Any loss, theft, or damage occurring during or after an event

  • Any injury, incident, or dispute arising at an event

  • Any issues caused by guests, venue conditions, or third-party actions

The Client assumes full responsibility for the venue, guests, and overall event environment.

Venue & Event Responsibility

The Client acknowledges and agrees that they are solely responsible for:

  • Ensuring the venue is safe, secure, and suitable for the event

  • Managing guest behaviour and crowd control

  • Ensuring compliance with all venue rules, licensing conditions, and applicable laws

  • Providing safe access and appropriate facilities for entertainers

Ascend Group Australia accepts no liability for risks arising from venue conditions or guest conduct.

Service Variations & Availability

From time to time, variations may occur due to unforeseen circumstances, including but not limited to illness, transport delays, or operational requirements. Where this occurs, Ascend Group Australia may, at its discretion:

  • Provide a suitable replacement entertainer of similar style and standard

  • Adjust timing or scheduling arrangements

  • Offer alternative solutions where reasonably possible

Such variations do not constitute a breach of agreement.

No Guarantees Disclaimer

Ascend Group Australia does not guarantee:

  • Specific entertainer availability unless confirmed in writing

  • Exact replication of promotional appearances, styling, or performance delivery

  • Subjective client satisfaction based on expectations not expressly included in the booking agreement

  • Uninterrupted or issue-free event conditions beyond our reasonable control

All services are provided based on confirmed booking details only.

Force Majeure (Events Outside Our Control)

Ascend Group Australia is not liable for failure or delay in performance caused by events outside our reasonable control, including but not limited to:

  • Illness or injury

  • Travel disruption or transport delays

  • Extreme weather conditions

  • Government restrictions or legal changes

  • Venue closure or unavailability

  • Emergencies or unforeseen operational disruptions

In such cases, reasonable efforts will be made to reschedule or provide suitable alternatives where possible.

Third-Party Services

Where third-party services are arranged, recommended, or utilised (including venues, transport providers, or external suppliers), Ascend Group Australia accepts no responsibility or liability for their actions, performance, or outcomes.

Any agreement with third-party providers is solely between the Client and the third party.

Legal Rights

Nothing in this Disclaimer excludes, restricts, or modifies any rights or remedies that cannot be lawfully excluded under the Australian Consumer Law (ACL).

Acceptance

By engaging with Ascend Group Australia services, the Client acknowledges that they have read, understood, and agreed to this Disclaimer.
